Court orders man to pay ex-girlfriend KSh 815k for impregnating and refusing to marry her

A young woman and medical doctor, identified as Nancy Fungai Tsuro, won a case against her ex-boyfriend and baby daddy, walking away with US$6,300 (about KSh815,535) in compensation.

This came after a Zimbabwean High Court ordered Francis Mupindu to compensate Nancy following a case in which he allegedly failed to fulfil his promise of marriage.

The amount was awarded to cater for damages caused after Mupindu allegedly impregnated her and promised to marry her, only to later abandon her.

While testifying in court, Nancy said she believed she had found a life partner in Mupindu, and that they had been in a relationship for four years.

The two reportedly met online, and their relationship blossomed, with Mupindu allegedly proposing marriage and actively encouraging her to conceive.

Nancy said she believed him and agreed, eventually becoming pregnant.

Did Francis declare marriage intentions before Nancy’s family

The medical doctor further noted that Mupindu visited her aunt and uncle in October 2021 to formally express his intentions. He reportedly arrived carrying groceries, a gesture traditionally understood as a sign of serious marital intentions.

While at her uncle’s home, Mupindu allegedly declared his intention to marry her in December of that year, but the promise never materialised.

Sadly for Nancy, her dreams of marrying the love of her life were shattered when she discovered that Mupindu was involved with other women.

He allegedly fathered five children with different women while still in a relationship with Nancy, even after the two had welcomed their own child.

Nancy claimed that he later disappeared from her life, subjecting her to humiliation, lonely hospital visits, emotional anguish, and abandoned dreams, including turning down a job opportunity in Namibia.

In his defence, Mupindu described their relationship as turbulent, marked by repeated break-ups and reconciliations.

He admitted discussing marriage with Nancy but claimed he had no genuine intention of marrying her.

The judge ultimately ruled in Nancy’s favour and ordered Mupindu to pay US$1,300 (KSh168,285) for pregnancy-related medical expenses, along with an additional US$5,000 (KSh647,250) for financial hardship and emotional distress.
