Court Of Appeal Affirms Agada-Led Benue APC Exco, Declares Omale Caretaker Committee’s Actions Null And Void

The Court of Appeal sitting in Makurdi has affirmed the Augustine Agada-led State Executive Committee of the All Progressives Congress in Benue State.

The appellate court delivered judgment on Wednesday in an appeal marked CA/MKD/119/2024, filed by the APC against the decision of the Benue State High Court, Makurdi, delivered by Justice T. A. Kume.

The lower court had nullified the dissolution of the Agada-led Benue APC State Executive Committee by the party’s National Working Committee and also set aside the appointment of a caretaker committee headed by Benjamin Omale.

Delivering the lead judgment, the Court of Appeal resolved all five issues formulated by counsel to the appellant, S. D. Swem, Esq., against the APC and in favour of Agada and the other respondents.

The court also upheld the consequential order of the trial court, which declared that all activities of the Benjamin Omale-led Caretaker Committee were null, void and of no effect whatsoever.

Benjamin Omale, who was listed as the 10th respondent in the appeal, aligned himself with the arguments of the APC but did not file any independent process before the court.

Reacting to the judgment, the State Publicity Secretary of the Agada-led executive committee, Daniel Ihomun, quoted the state chairman, Austine Agada, as expressing confidence in the judiciary’s ability to uphold justice.

Agada urged members of the party in Benue State to remain calm and united in the interest of the APC.

The judgment is expected to settle, for now, the leadership dispute within the Benue APC and strengthen the position of the Agada-led executive committee as the recognised leadership of the party in the state.
