A Lusaka Magistrate’s Court convicted Benny Kasongo, a 21-year-old barber from Kanyama Township, after he falsely claimed that his private parts had gone missing.

Magistrate Martin Namushi found Kasongo guilty, noting that the prosecution had proved he deliberately gave false information to the police with the intention of deceiving them.

Kasongo falsely reported that his private parts had disappeared, which was later established to be untrue. He was charged alongside two other men, 31-year-old salesman Justin Banda and Alfred Mwenge, a pupil at Kanyama Site and Service School.

While Banda and Mwenge admitted the charge and were each fined K620 (about KSh 4,400), Kasongo denied the offence.

As a result, his case proceeded to trial.

Police officer recounts bizarre incident on public bus

Police officer John Ngufumali told the court that on March 22, at around 9:00 am, he left home and boarded a public bus carrying four other passengers.

While on the bus, one passenger suddenly began shouting that his private parts had gone missing. Moments later, two other passengers made similar claims.

Ngufumali said he instructed the driver to proceed to the nearest police station, where the matter was formally reported.

However, upon inspection, Kasongo, Banda and Mwenge were all found to have their private parts intact.

In his defence, Kasongo insisted that Officer Ngufumali had come into contact with him while boarding the bus. He claimed that he felt something unusual afterwards, after which his manhood had “shrunk”.

Magistrate Namushi dismissed Kasongo’s defence, ruling that he had intentionally provided false information to the police.

The court reserved sentencing to a later date. Kasongo now faces a sentence of up to two years’ imprisonment with hard labour or a fine.

Netizens react

Mwaka Nakaponda:

“He has a smartphone but failed to use it smartly. If really the sampo did disappear, he should have taken a picture and presented it as evidence. Even then, he could still have to prove that the one he was accusing is really the one who performed that magic. The lesson is that some matters are hard to prove and are better left unsaid.”

Ebenezer E Junior:

“The problem is court deals with evidence, not feelings and assumptions so even if Kasongo felt the disappearance of his private parts as long as he had no evidence, he is in for it…. that’s law for you!”

Toriah Sacky:

“There is no smoke without fire; he can not just start shouting my private parts are gone kwati lishilu I’m sure they did disappear people are wicked these days.”
