“Primary Not Conducted” — Court Adjourns Suit Against APC To July 15

The Federal High Court sitting in Jalingo, Taraba State, has adjourned a suit challenging the conduct of the All Progressives Congress primary election for the Jalingo/Yorro/Zing Federal Constituency to July 15, 2026, for hearing.

The matter, which is before Justice Mashkur Salisu, was adjourned on Wednesday following applications filed by the All Progressives Congress and the incumbent member representing Jalingo/Yorro/Zing Federal Constituency in the House of Representatives, Hon. Prince Tafida Abas, seeking leave to be joined in the suit and defend the action.

The suit was filed by Hon. Princess Leah Olusiyi Solomon, who is challenging the primary election that allegedly produced Abas as the APC candidate for the 2027 general election.

Princess Solomon is asking the court to nullify the outcome of the primary election, alleging that the exercise was not conducted in the federal constituency.

When the matter came up for hearing, counsel for the APC and Hon. Abas informed the court that they had filed motions seeking leave to join the suit.

Counsel for the plaintiff, Barr. Longs Lugnan Takdok of P.D. Pius and Associates, did not oppose the applications, saying the parties seeking to be joined were entitled to defend the case against them.

Takdok said the adjournment became necessary because the APC and Abas had filed processes asking the court to allow them participate in the proceedings.

“The matter was adjourned for hearing today, but on coming to court, both the APC and Honourable Tafida Abas filed a motion, praying the court to allow them to join the case and defend the suit against them,” he said.

“We did not oppose the application because the motion was based on the constitutional right of the defendants to defend the suit.

“They have filed their defence. We will go through it, respond accordingly and proceed.”

The court consequently adjourned the matter to July 15, 2026, for hearing.

The case is one of the pre-election disputes arising from the conduct of party primaries ahead of the 2027 general elections.

Princess Solomon’s main contention is that the APC primary election for Jalingo/Yorro/Zing Federal Constituency was allegedly not held in the constituency, and that any result said to have emerged from the exercise should be set aside.

The Jalingo/Yorro/Zing Federal Constituency seat is currently occupied by Hon. Tafida Abas, whose emergence as the party’s candidate is being challenged in the suit.

The matter had earlier suffered delay after proceedings were stalled at a previous sitting, prompting the court to fix a new date to allow parties to properly respond and participate in the case.

With the latest adjournment, the court is expected to hear the pending applications and proceed with the substantive issues concerning the validity of the disputed APC primary.
